Hello all,

Have had a dig around regarding this issue and can find the following: https://www.rightsnet.org.uk/forums/viewthread/3344/

Client is polish national, pension age and came to the UK within the last 5 years but lives with her daughter who has permanent right to reside. She gets a polish state pension and has never worked in the UK. She recently applied for AA and this was refused on the grounds that Poland is her competent state. AA have made contact with Polish social security to progress her claim.

Looking at the above discussion, it looks like there might be no wriggle room on this. Is that right or is it worth submitting an MR etc?

On the bald facts as stated, it’s difficult to see a way you could mount a challenge to Poland being the competent state in this particular case.

Henri at CPAG got in touch with me after I posted the last post in the thread you linked to and directed me towards this article which summarises the current state of play European nationals and sickness benefits
