I am assisting a claimant with a PIP appeal against a decision of the Department for work and Pensions dated 19 January 2017. I note that changes to the legislation relating to “psychological distress” took effect from 16 March 2017. Does this mean that the First-tier Tribunal must address the appeal based on the pre-March changes notwithstanding that the appeal is yet to take place?

If the decision was made prior to 16th march then yup the FtT should use the regs that were in place at that time.
