Child Benefit from Birth When Child Taken in to Care

Situation: Young person (17), first-time mum to be, on IS at the moment due to pregnancy related health problems. Social Worker has asked me what will happen to her benefits if they take the new born away from her at birth? This is highly likely and highly unlikely that child will be returned ever.

I’m happy that IS will continue in short-term due to being within 15 weeks of the pregnancy (its not to do with having the child with her) and obviously IS as a LP after that time only possible in this case if child is returned to her.

CTC I think will not be possible because young person will not be classed as being responsible for a child.

But what of CB? CPAG suggests even in cases where the local authority takes responsibility for the child, CB is payable for 8 weeks. I cannot find a rule saying the child must have been with you for x amount of time before hand….

Anyone know any different? Many thanks
