S74 offset of Support Component against LCWRAE

Hi hive

Just spotted a case where a NSESA claimant later claims UC,it looks very much like UC have done the wca referral and have only awarded the element from month 4 of the UC award.

I suspect esa don’t know about the WCA outcome yet and when i let them know there will be arrears of the Support COMPONENT. (curse my one handed typing).

In the good old days the SC arrears would be offset; any chance of that happening here do we think?

I hesitated over the last few days whether to post because…............... Suffice to say nah never ever seen it happen. Despite attempts including cases when even the MP is involved.

In fact we even had a case in which colleague helped client post on UC journal to say they had made a NS ESA claim. No offset inevitable overpayment that could have been avoided.

Plus a £50 penalty over turned at the MR stage.
