Hello all

A bit of a long shot to nothing.

Are there any rules relating to tribunals and any time period for sending written statements.

I wrote to the tribunal service in April 2010 asking for the written statement reasons for a refusal to set aside. I sent them reminder letters in May and June, all sent recorded delivery. I still have not received the written statement, or even acknowlegement of my request.

Don’t do many appeals, especialy to past set aside stage. Is this typical and acceptable.

Regulation 34(5) of the Tribunal Procedure (First-tier Tribunal) (SEC) Rules 2008 states that the Tribunal must, subject to Rule 14(2), send a written statement of reasons to each party within one month of the date on which it received the application, or as soon as is reasonably practicable after the end of that period.

In reality, I’ve waited three months and longer for it to arrive…

Write to the Regional Tribunal Judge rather than a clerk and make it a (gently-worded??) complaint..

Though you may find that TS has been chasing the Judge for months anyway….
