Hi there

THink I may be overthinking this one. Client who gets PIP and previously was getting ESA WRAG with SDP. Has started work recently (within a month) and killed off ESA. We are looking at whether it is advantageous for them to claim UC while working. The maths says it will be if SDP compensation amount is paid.

I know you have to still be entitled to SDP. On the basis that she’s living alone, gets PIP with no CA then SDP would continue. However, the work would stop there being an award of ESA to pay it through.

Does she meet the criteria for SDP compensation?

I don’t believe so, unless the claim for UC is made within one month of the ESA claim ending.
You are right that the SDP continues - in her HB (if she has HB for rent).
If she claims UC more than one month after ESA ended, then she is entitled to an SDP in her HB immediately prior to the UC claim, but this is not sufficient to qualify for the SDP transitional element in UC, unfortunately.

Opening post says it is within one month so SDPTE should be applicable.
