Has anyone had folks on IS on disability grounds who were never assessed for ESA? Client aged 62 found benefits terminated and when she called she was told she had to claim UC. Will she have to go through WCA from scratch? Also it gets them out of a 2 week run-on if they’ve stopped it prior to her claiming. Shoddy way to treat people.

Update - DWP says IS was on carer grounds (cared for person has now died) but client believes she had IS on disability grounds too.

We’ve had a couple of cases with mixed-age couples in this situation and yes they do need to supply fit notes and seek a WCA in order to try and establish entitlement to LCWRA element with UC. One of ours had ERDL/ERM PIP as well and would have been better off on ESA but wasn’t able to switch. It’s a harsh system if you ask me.

As much as people don’t want to do it, trying to encourage client’s to claim UC before their legacy benefit terminates is generally a very good idea in terms of run-on’s and being able to carry over ESA status where applicable.
