Marriage allowance backdate, impact on benefits

Hi there,

I was wondering if anyone has come across this one before. I have a client who has a joint universal Credit claim with her partner, and also new style JSA in place.
I have identified that the couple are entitled to the marriage allowance due to one partner being a basic tax payer and the other being a non tax payer.

The couple may be entitled to a backdate to 2017. I was not clear on whether or not the amount would fall under earned income in the UC regs?
And also the impact on JSA if any?

I’m not familiar with how the marriage allowance works in practice but if it results in an income tax refund then the refund will be treated as earnings for the UC period in which the refund is received if the person who receives the refund was employed/self employed in the year to which the refund relates.

Thank you for confirming.
I’ve managed to work out that due to the claimant’s partner being the one who will benefit from the marriage allowance it should not impact on the new style JSA of the claimant.
