I’m after some quick advice. I have a client that looks after his disabled daughter 3 weekends a month. He is looking at renting a property as he is currently living with parents and it’s crowded. He is 29 years old. I am of the opinion that he would only be entitled to LHA at the shared accomm rate as he is not the main carer for his daughter. Am I correct?

Yes that’s right, assuming there is somewhere else that she calls home.  The fact she is disabled doesn’t help if she isn’t living in the accommodation as her normal home.  The best he can hope for is a carer element/carer premium if his share of the caring duties tots up to 35 hours a week, but that is unlikely to be enough to make up the rent shortfall.

With regards to the carer element in UC, as this is in payment to mum, he can’t get that either.
