DLA british child NRPF

client is nigerian has limited leave to remain with NRPF - mother of british child - she applied for and was awarded DLA For the child. is this correct?

assume she still cant claim CB, carers allowance, UC etc.

seen people writing about applying for NRPF to be lifted - is this a covid thing why they are lifting it? is it temporary lift or permanent? is it backdated or just from date apply?

CPAG Benefits for Migrants states:

“If your child is not a person subject to immigration control or s/he is but s/he comes into one of the exempt groups e, s/he can claim disability living allowance (even if you are a person subject to immigration control)”

So it seems she can claim DLA for the child. She still can’t get child benefit, CA or UC.

Regarding lifting the NRPF, this is available to people on certain routes to settlement if they are at imminent risk of destitution. If she has leave as the parent of a BC child then she could apply depending on her circumstances but it would place her on the ten year route to settlement so she needs to get immigration advice before doing so. It’s not Covid related, been available for a while but up until recently, applicants needed to be pretty much on the street before applying. Free application usually dealt with in good time.

so she has just told me she has got the NRPF restriction lifted - not seen the letter yet
does this get backdated or is it from decision/application date?
can she now claim any benefits with no restrictions? or does she then have to be a worker etc. or is that irrelevant as she isnt EU. so now is she just a normal person with limited leave to remain with no restrictions so can claim all benefits?

No, its not backdated.

Yes, she has a right to reside and is not a PSIC so that will usually be sufficient to get over residency rules.
