Entitlement of a refugee with pre-flight child to a Sure Start Maternity Grant

The Upper Tribunal has allowed the appeal of SK, a refugee who arrived in the UK with a child and was refused a sure start maternity grant when she had her first child in the UK.

Other claimants in a similar situation should make claims for an SSMG.

This is brilliant Martin. It’s always struck me as extremely unfair, and glad CPAG have taken this so far! I’ve shared the news on a forum for organisations working in the refugee sector to try and get the word out also.

I was wondering, do you think this would apply also to people who are not granted refugee status but get some kind of leave to remain following their asylum claim (i.e. LLR, humanitarian protection, as a victim of trafficking) with recourse to public funds, if they still could not have been expected to take baby items with them during their journey to the UK?

Thanks.

Apologies for not replying quicker -didn’t see it.

I think there may be an argument that this is the case- seems to me that fact the HR rather than the EU law ground succeeded supports such a conclusion. Certainly, if you have such clients then they should make this argument to FTT.
