DWP accept that UC claim was fraudulently made

The DWP have accepted that a claim has been fraudulently made in the claimants name.  When claim for UC was made legacy benefits were stopped.  DWP accepted that it was fraudulent and agreed to reinstate legacy benefits.  Now they are saying that she has to proceed with making a valid UC claim and will not reinstate legacy benefits.

Has anyone else come across this?  The other issue is around backdating - will they backdated the valid claim to the date the fraudulent claim was made and legacy benefits stopped if they won’t reinstate?

If they accept she did not make a claim for UC then all the decisions ending legacy benefits were wrong and need to be revised to reinstate them.

The question they need to ask was what was the basis for those decisions? It was that she made a claim for UC. Now they accept that she did not…..
