Moving to supported accomdation - must claim HB and UC?
Client has been a long term hospital patient.
Only in receipt of IBESA and PIP.
He’s due to move to supported accommodation.
He will need to make an HB claim for the supported accommodation.
But will his IBESA stop and require him to make a UC claim?
I’ve tried to go through the UC Transitional Regs but just can’t find the answer.
Thanks very much to anyone that can help.
No, there is absolutely no reason for his ESA to stop. It is true that the UC Transitional Provisions Regs say you can get UC alongside HB ion supported accommodation, but it isn’t compulsory! Only one new claim is required here - the HB claim, which is allowed by Article 7 of WRA 2012 No 23 Commencement Order. Nothing else needs to change.
If his PIP payments have stopped because he’s in been in hospital for more than 28 days he will not longer be entitled to the SDP.
However, only the PIP payments have stopped, not his entitlement, and payments will resume once he leaves hospital, bringing with it entitlement to the SDP.
I don’t think you’ve mentioned anything that indicates the ESA would stop.
CPAG chapter 42 I think.
Thanks very much both.
