Transfer to UC from ESA following trialing work.

Any thoughts gratefully received.
Cl was on IRESA with support component. Tried working for a couple of months and ESA stopped. this didn’t work out so claimed UC. UC award does not include LCWRA element.
In the old days he could have reclaimed ESA and received the support component under the linking rules. UC regs suggest only entitled to LCWRA element if in receipt of ESA immediately before UC claim.
Is anyone aware of any provision to assist my Client or has slipped through a net?

I think he’s slipped through the net.

The work ended the ESA claim, and there’s no linking rule or similar that will help him where UC is concerned, and as you’ve spotted, the Transitional Provisions Regs only assist when the claimant is entitled to ESA when they move to UC.

I think this person has to start again from scratch.
