Hi All,

Wondered if anyone knows as I can’t seem to find the information anywhere.  We have a cl who was on ESA WRAG group and due to a change of circumstances has moved onto UC, he has been asked to complete a new UC50 to assess his LCW entitlement.

My understanding is that if he was already assessed as LCW then his UC should include the LCW or LCWRA element he previously had.  I was aware previously that this was being missed a lot by the DWP and that there was a specific form that UC should be requesting from ESA to ensure that they migrate the relevant LCW rates onto the UC award.  Does anyone know about this or if this has changed? and if so what the form was called?

Thanks in advance.

I think this is the most recent system - https://www.rightsnet.org.uk/forums/viewthread/11307/P75/#66569

But if you’re having problems quote reg 19 of the UC (TP) Regs 2014 at them

Just a note to say he should still return the UC50. There is pretty much nothing to prevent DWP reassessing LCW at arbitrary intervals.

I’ve persuaded them to drop WCA reviews in these circumstances where the prognosis period for ESA has not expired.

The relevant guidance is at ADM M6192; better to quote that than the regs.
