I’m looking at the words, but not sure they compute.

Mother is claiming UC for 17 year old daughter, who has left college, so she rang Child Benefit who agreed to keep paying (despite the fact she had not registered available for work, education or training…).

Asked UC to keep paying as well, who have said yes, no and maybe - but mainly no.

Reg 5 of the UC Regs is all about being in training etc.

A CPAG Scotland factsheet says :

The next bullet only applies to CB and CTC.
■ Extension period: if someone leaves a course aged 16 or 17, and registers with Skills
Development Scotland, you can continue to claim benefit for them for a further 20 weeks
(unless they reach their 18th birthday before then), from the day after they leave the course.
To receive payments within the extension period you must apply within three months of the
course finishing.

Does this mean that UC is right to refuse to include child beyond date she left college? (for the sake of argument, let’s forget the issue about being registered available for work).

Yes, this is correct. There are also other differences between CB and UC. For example, for 19-year-olds, UC only pays until 31st August after 19th birthday, whereas CB can pay until they turn 20.

I can see that UC guidance says an additional amount won’t be paid for :

 aged 16 and not in full-time non-advanced education

If that’s as far as it goes, it doesn’t look too promising.

Just to update.  I’m happy our advice on the issue is correct, but UC have decided to include child in claim anyway.

‘We’re Universal Credit, we do what we like.’
