Benefit cap, debt recovering = £68 a month to live on!
Hi there
Looking for guidance while we wait on a late MR for LCWRA. Client is single and is in LCW for UC from Feb 2019. Prior to this was on JSA.
Her SA for UC is £317.82 less benefit cap of £203.65, advance £15.89, DWP o/p £10, HB o/p £10 & tax credit o/p of £10 = £68 to live on. She has exhausted local food banks.
Once she’s hopefully put in the LCWRA this will remove the benefit cap but in the meantime she is pretty much destitute. Her private rent/housing element of £1170 is paid direct to her landlord.
Any options? PIP is on appeal too.
Many thanks!
How about applying for a DHP?
See para 2.11 here.

Sorry, missed out in my post that he has a DHP.
How much is the DHP?
By a quick QBC she should have £68 to live on before any DHP…
His DHP is £20 pwk.
Apply for a Debt Relief Order? That would get rid of the overpayments and give her another £30 per week.
I will suggest this to her - I’m not a debt adviser but this could be her way out of debt.
Thanks everyone 😊
