Specified or temporary accom - UC claimant getting HB - evidence already provided by DWP

Just wondering, in terms of the “verified by DWP in last 12 months” rule - whether the same applies to UC claimants getting HB for housing costs (ie because in specified or temporary accommodation) - specifically in terms of where verification of info already done for UC.

The legislation - the Social Security Claims and Information Regs 2007 - doesn’t appear to have been amended to include UC in the list of “specified benefits “

(Use of social security information: local authorities

2.—(1) This regulation applies where social security information held by a local authority was supplied by the Secretary of State to the local authority and this information—

(a)was used by the Secretary of State in connection with a person’s claim for, or award of, a specified benefit; and

(b)is relevant to that person’s claim for, or award of, council tax benefit or housing benefit.

(2) The local authority must, for the purposes of the person’s claim for, or award of, council tax benefit or housing benefit, use that information without verifying its accuracy. )

By the way in the banner at the top of the regs (in legislation.gov.uk ) it says there are no known changes….

I don’t think the Secretary of State supplies any information to local authorities in a UC case, other than the fact that the claimant has claimed UC (the stop notice).  Slightly more is provided for CTR purposes, but that is not “social security information” as defined in s7B of the Administration Act.

The 2007 Regs were brought in to support the CMS/CAM system where legacy DWP systems generate input docs for local authorities.  They don’t get that sort of content in a UC case.

Having said that, there isn’t a great deal the Council needs to know in a UC case as the claimant is passported to max HB.

The reason we posed the question was because there was a UC claimant in specified accommodation who failed to provide her ID proofs to the LA, but had already provided them to DWP for her UC award, so we were wondering if the fact she’d provided it to them within the last 12 mths would help.
