Hi

I’ve been asked for advice about a PIP review.  The claimant has severe mental health problems and would not give an accurate picture of his own problems.  His mother was his appointee but she died two weeks ago.  His sister is trying to help with the review and asked for a copy of the form that his mother completed so she has a starting point - as she can clash with her brother and he won’t always co-operate, speak to her or see her.  The DWP has refused saying she has to complete the form from her own perspective.  Does the claimant have the right to a copy of his last claim, and if so what is the quickest way to get it?

Do a subject access request. If they haven’t destroyed it, they will have to send him a copy - although it might not arrive in time for completing the form.

Otherwise, phone the helpline up again and hopefully speak to somebody less obnoxious who will give him a copy.

The sister would need to become his appointee before DWP would consider providing a copy of the claim form to her. A right of access request would probably yield a copy but it would take up to a month to arrive.
