Hi all,

CPAG has some funding (thanks SLF) to develop a case challenging the attempt to provide that limited leave to remain granted under Appendix EU (“pre settled status”- PSS) is not a sufficient right of residence to satisfy the residence test for means tested benefits / child benefit.

If anyone has clients who have been refused benefits on residence grounds despite having PSS please do get in touch - .(JavaScript must be enabled to view this email address)

Helpfully been reminded that our proposed arguments clearly apply to those who can rely on TFEU Article 18 (the anti-nationality discrimination provision in the Treaty). That means that the ideal client is themselves an EU national (rather than family member of EU national or non EU-EEA national).
