Very frail client gets ESA SG, DLA mrc and SDP. He lives in one bed flat with a rota of family members sleeping on his couch overnight to check he’s safe. All of the family members have their own accommodation elsewhere but one in particular travels over from Ireland and can stay with him for over 2 weeks. No one claims CA for him. Is his SDP allowed?

Hello Anon,

I would say that yes the SDP is allowed on the basis that someone cannot ‘normally live with you’ if they normally live elsewhere. p336 of CPAG 18/19 under ‘who is not a non-dependant’.

I don’t think it can reasonably be said that any of them normally reside with him - he therefore has no “non dependant” normally residing with him and should qualify for the SDP
