Urgent advice needed for young adult on PIP with parent receiving a sickness benefit from non EU country
Hello all - your advice is urgently required on this case.
We have a young adult suddenly refused PIP daily living due to the fact their parent is receiving sickness benefit from a non EU country - they have been in receipt of PIP for years but this has only just happened.
DWP insist they can retain their mobility component yet appear to take no account of the social care needs of our client, DWP state that they deem them to be a vulnerable adult and therefore the responsibility of the state who is paying their parent regardless of the fact they are in the UK…....
I have never come across this situation so urgent advice needed!

what is his parent’s immigration status?

Quite. What countries are the protagonists from, what are their nationalities and what are their histories abroad? Which country is paying the sickness benefit?
It is immediately odd that you say that it is a sickness benefit from a non-EU country.
It might be an EEA country… Norwegian disability benefits were quite generous when I was seeing a lot of R2R cases.
