UC, bereavement and possible housing element overpayment

Hi all,

Client claiming UC following death of partner. Is in receipt PIP. UC have switched off claimant commitment for 6 months as recently bereaved. Has submitted fit note. 

Lives alone now in 3 bedroom property.

I was expecting that UC housing element would be reduced because of bedroom tax. However UC have paid full rent in first payment.

Is it likely that UC has made made a mistake in paying full rent?

Yes I think bedroom tax should have been applied as no protection on a new claim - see https://www.rightsnet.org.uk/forums/viewthread/13614/#64606
