Does LHA amount apply in UC if pre April 2008 tenancy

Hello everyone.  I prob should know this but rarely dealt with private rented.

A person has gone from HB to UC and when they were on HB the LHA didn’t apply because their tenancy was pre 2008 but their eligible rent had been limited a bit by Rent Officer.

Now on UC, still in same tenancy, does the amount of the LHA apply or ...?

Yes, it applies even if the tenancy is pre-April 2008.

24. Private Sector Rents etc (Schedule 4, part 4): clarification is required as to whether
tenants who are currently excluded from the LHA rules (eg Rent Act protected
tenants) are included in the new scheme.
All private-rented sector tenants who are entitled to the housing costs element in
Universal Credit will have that assessment based on the relevant LHA rate.
