Failed HRT for UC - Receiving JSA new style

Hi,

Wondering if anyone can give some advice on this one.

I have a case, the lady is 23 now and baby is 19months. the lady came to the country when she was 17, lived with her dad whilst she went to college for a year. she has 4.5 yrs work history. finished work last year after a relationship breakdown.  she has failed two HRT’s and UC have turned down the MR. She is receiving JSA new style but they have refused entitlement to UC.

Where are her and her dad from, do they have recourse to public funds, are they EEA nationals - that is the starting point

Bear in mind rules for contribution based benefits, such as new style JSA, are different to rules for means tested benefits such as UC.
