Hi all,

I need help understanding second paragraph of CPAG handbook page 922 please.

It states:

For ESA only, you qualify for the enhanced disability premium if you are getting the ESA support component, even if you are not receiving the DLA care component or PIP daily living component.”

Client moved into care home over year ago. PIP care stopped as appropriate. ESA support group award reduced to £73.10 by DWP on grounds that client in care home.

DWP telling me that the above enhanced premium paragraph does not apply.

Is DWP correct in this?

Thank you!

Lee

If client definitely in the support group, there is no reason why the support component and enhanced disability premium would not continue simply because s/he is now living in a care home. Something clearly not correct here on the basis of what you have said and appears to be an “official error”.
