Interestingly we have just received for the first time a copy of the MR referral form in an appeal bundle (UC WCA appeal) - half the other evidence before the DM like the GP report is missing - but then we can’t expect to receive the really important docs. can we?

At least your getting MRs! My attempt to get one yesterday on a closed UC claim (client on psychiatric ward had provided false and delusional info to UC ending his claim)  was met with - we can’t reconsider the decision because no decision was actually made. The computer just closed his claim down automatically.

Sorry is this is a stupid question but not done a UC MR yet
On a very practical level requesting a MR via the journal…
How are advisers submitting supporting evidence such as medical reports on LCW, by post separately?
If we are writing on behalf of client how does it come from “us” rather than the client if we are not writing a letter on headed paper?
MR requests can be quite lengthy in LCW/RA challenges, are you just putting them directly onto journal?

Maggie, it does depend on the point of dispute. I tend to lodge the MR via the journal and request an uplink so I can provide additional information, e.g. letter from medical professional. We’ve not had problems doing this - the main issue is the delay in getting a MR decision made (although some have come back surprisingly quick - less than a month)

I recently received one involving incorrect RTI information going back to March. I made a three pronged attack - complaint, FT-Trib requesting requirement for an MR waived and also a Pre-Action JR letter.

It was the JR letter that did it - the MR was posted on the journal within three weeks. The complaints team were less use than a chocolate fireguard.

I am hopeful that we won’t have to wait a further 10 months for the underpayment calculation.

In the meantime unfortunately, they are continuing to use incorrect RTI on subsequent decisions so it’s looking like we will be lodging monthly MRs, despite the fact that wageslips have been uploaded monthly showing the correct information. #bangsheadonwall

don’t do that.  you’ll end up with a TBI and wrestling with them on your own behalf as a vulnerable person
