“The Last Ever Claim to Income Support”, or Full Service UC by Postcode

Set up:  young person, estranged from parents and in education was helped to make a claim for Income Support by his social worker. The claim was made 11th December 2018 at the local job centre. The very next day, Full Service Universal Credit rolled out. DWP have refused the claim on the basis where client lives, lets call it Castle Black, is attached to a job centre that went FSUC on 7th November.

While advising the social worker I used the Entitledto UC Postcode Checker which on the basis of his Castle Black postcode had him attached to a different job centre that went FSUC on 12th Dec.

Funny thing this UC roll out, splitting communties right down the middle - half of Castle Rock are attached to one job centre, half the other.

So - I want to challenge the DWP but where in law is it stated which postcode is attached to which job centre? I take it Entitledto got this information from somewhere. When I use the .gov website it does show my client’s part of Castle Black is attached to the job centre that went later, not earlier.

There are approximately six-hundred-thousand UC-themed Statutory Instruments which are available on the revenuebenefits site and which define the postcodes which went full/live service on particular days (https://revenuebenefits.org.uk/universal-credit/legislation/secondary/commencement-orders/)

The commencement order you probably need is this one “The Welfare Reform Act 2012 (Commencement No. 17, 19, 22, 23 and 24 and Transitional and Transitory Provisions (Modification) (No. 2)) Order 2018” which gives the postcodes going full service on the two days mentioned:

You should be able to figure out who is right by checking the first half of the postcode (and possibly the first digit of the second half) against the list in the Schedule.

It’s the postcode that matters - not the jobcentre or local authority to which that postcode is attached.
