Whilst we don’t routinely cover child support, there are a couple of new sets of regs that might be of interest ...

Child Maintenance and Other Payments Act 2008 (Commencement No.16) Order 2018 -

... allows the Secretary of State to apply to a court to disqualify a non-resident parent with child maintenance arrears for holding or obtaining a United Kingdom passport.

Child Support (Miscellaneous Amendments) Regulations 2018 -

... introduce a number of changes, including how child maintenance liabilities are calculated, increasing the range of collection and enforcement powers to help collect more money and address historic arrears that built up under the 1993 and 2003 Child Support Agency schemes, and new powers to write off debt that has been sequestrated.

which of course could result in the non resident parent leaving the country and thus the jurisdiction of the child support agency/tribunals/etc making enforcement even more difficult for the resident parent….

New consultation on changes to child maintenance powers to obtain information including -

- an increase to the level of protection for the public when a Child Maintenance Scheme agent needs to use their powers of entry to premises
- expanding the list of organisations that must comply with requests for information to include pension providers and mortgage lenders
