Further to the recent news item  if people win an ESA appeal having been migrated to UC I read that as if the arrears will only be payable to the date of the UC award.

Surely there’s a huge incentive to migrate people just before their appeals if that’s the case. In the current climate I can see that happening as well.

Dan - I think it’s only addressing the transitional protection view point - so it’s saying it will pay the arrears and look at what the amount of ESA on migration day would have been with the result of the appeal applied. It then recalculates transitional protection which presumably will now be higher.

Any issues about LCW/LCWRA element being included would be applied as in reg 19 of the UC(Transitional Provision) Regs now - http://www.legislation.gov.uk/uksi/2014/1230/pdfs/uksi_20141230_280218_en.pdf
