Retaining Child/QYP Status

Client’s daughter (just turned 19) has temporarily stopped attending her non advanced college course due to her mental health issues - course remains open for her to resume “any time she feels she can cope” (daughter receives DLA inc H/R care, will not claim any other benefits)

Child Benefit has stopped after 6 months. HB have followed this decision, removed daughter from the applicable amount and decided she is ND with an NDD of £15.25 pw

Client is challenging the Ch Ben decision as per CB reg 6/(2) and (3) which seems to allow for interruptions in education indefinitely if the length of this is “reasonable in the circumstances”

Does the above “retaining QYP status during interrupted education” argument apply to HB?

Yes it does, unfortunately the LA will say as CHB entitlement has actually been decided they can only follow suit till the appeal is resolved. Doesn’t stop you appealing the HB decision though.
