Son moved in with father (the tenant) a year ago. Tenant has now gone abroad and left son in the home. Do you think he will be treated as liable to pay rent and be able to claim HB?

They might do - councils often do (probably more often than not).  Council will have to decide whether it is reasonable.  That will include looking at the father’s finances and future intentions.  If the father has moved out for good and has no further interest in the tenancy it is quite likely the son will be treated as liable.

Thanks HB Anorak. We now have another similar case but with UC and added complications! Tenant (woman) is sentenced to 6 months in prison. She was on HB. Ex partner who is child’s father wants to move in to mother’s house to look after child. He is on UC live service with no current housing costs. Would/could he be treated as liable to pay rent at child’s mothers house whilst she is in prison?? Mother can’t get HB as sentence expected to be more than 13 weeks.  He lives with parents and no room for child.
