3 kids for UC or legacy purposes

Hello,

This may be a stupid question, but is the ‘three children’ for legacy over UC purposes on the basis of whether they are a qualifying young person or not? I have a family with a 5,10, 17 and 19 year old. The 19 year old lives away from home. The 17 year old is at home, but doesn’t meet any criteria that makes them a QYP. Does she have to claim UC?

Yes it is - it’s about the number of children or qualifying young people there are - so if there are only two then it will be UC if you are full service
