Twice-monthly UC payment flexibilities in Scotland

Regulations bringing in payment flexibilities (SSI.No.227/2017) have been drawn to the attention of the Scottish Parliament to consider further clarifying the meaning of ‘twice-monthly’.

Convener of the Delegated Powers and Law Reform Committee explained the reason for referral -

’Our legal advisers have identified that the regulations could more clearly implement the policy intention in relation to payment dates, given that, under regulation 2(1), a person has an entitlement to request “twice-monthly” payments. That expression does not specify the payment dates in a month, the fact that they should be roughly equally spaced apart, how they may be calculated or who may determine the dates.’

I think the Scottish parliament are about to learn some lessons in the detail needed in the drafting of social security primary and secondary legislation.

the current drafting of “claims” in the draft social security bill is giving the fears of ending up in tribunals going through the old review/supersession rigmarole/date of claim debates we have seen over and over in the uk system.
