Are students over 21 years old exempt from NDD’s?

Found something saying they aren’t and then something saying they are

Not as far as the regs say - Schedule 4 para 16 UC Regs - only those under 21 - http://www.legislation.gov.uk/uksi/2013/376/schedule/4

That article was actually about the April 2013 change to non dep deductions in HB ( and IS,PC,etc)  -  treating non-deps on UC-with-no-earnings in the same way as non-deps on JSA(IB)  : nil deduction if age<25.

Unfortunately it reads as if the UC HCC rules had been changed - they weren’t.


From April 2015   there’ll be a silmilar rule for CTR NDDs in England (for pension-age) and in Wales (working and pension-age). There, non-deps on UC-with-no-earnings will attract a nil deduction (at any age).  It doesn’t look as though Scotland has followed suit. For working-age claimants England some LAs (but not all) are doing the same.

can anyone clarify whether non dep deductions are still taken against someone in receipt of PIP/DLA under UC regs - I’ve had a client had the shock of her life because they’ve done this - son is 27 and also claiming CA alongside UC himself.

See p512 of current edition of our WBTCHB.
If claimant gets PIP dlc or middle/high rate DLA care then no HCC deduction made.
If non-dep gets CA then no HCC deduction made.
