Recovering an allegedly recoverable overpayment of Income Support from Tax Credits.

Quick question. On what basis can an allegedly recoverable overpayment of IS be recovered by deductions from Child Tax Credits? Client is a student. Facts sketchy at present so we’ll be looking at whether IS o/p is in fact recoverable and whether there’s scope for a challenge to that. However, until we dig out those facts I’m struggling to establish the legal basis for a deduction.

p.1237 CPAG 2017/18, Note: overpaid benefit cannot be recovered by making deductions from tax credits.
