Income Support for Albanian National

Clt is Albanian and husband Kosovan.  He arrived in the UK 20 years ago and has refugee status (indefinite leave to remain).  Clt arrived in 2010.  Husband has worked sporadically and clt has not worked at all.  3 children, 2 in full time education.

Husband last job was 16 hours per week for 2 years and finished in January 2017.  Prior to that they claimed Income Support for 2 years.

Clt moved in with husband and lived at his mother’s house.  The relationship broke down temporarily so he moved out into private rented.  2 years later clt moved in with him (their current home).  They have lived in private rented for 2 years together.  Husband was convicted and given a 12 month custodial sentence in March 2017.

As we are in a full digital service area clt is unable to claim UC as 3 children.  She has applied for Income Support as a lone parent.

Can anyone confirm if she will be entitled to Income Support given her circumstances above?  I am out of the office all day and no access to our resources or flowchart to confirm so would be very grateful if anyone could advise?

What is her immigration status?

Unless I’m missing something, Albania and Kosovo are not EEA states so on the facts you have given, your client won’t get any sort of EU law right to reside.
