I have a client who’s ESA entitlement stopped after 12 months pending her WCA.  Once assessed she has been placed in the support group and is now receiving £109.65 per week. She is not entitled to any premiums.

She has been backdated however only on a rate of £109.65 per week, should I be arguing that she should also receive the main phase of ESA for this duration.

Hope that makes sense?

Hi - £109.65 is the basic main phase rate (£73.10) plus the support group component (£36.55) so it sounds like they have paid the correct amount over the backdated period - unless I’ve misunderstood you?

After the first 13 weeks of her claim she would be entitled to the £109 odds so that weekly amount should be backdated to the 13th week of her claim
