following on from the Carmichael’s success in the Supreme Court.

essentially, given that the primary legislation did not require a departure from Convention rights, the FTT should have decided in that way rather than importing words into the subordinate legislation (the regulations).  SEc of State’s argument that tribunal had no jurisdiction and people should have been forced to issue civil proceedings for damages held no sway at all

very lengthy, but well worth a read…..
