6. The claimant has reached the qualifying age for state pension credit and is entitled to a disability living allowance [at the higher rate] or the mobility component of personal independence payment [at the enhanced rate].

In addition to your comments re AA, doesn’t this also mean that if the Older Pensionable partner has along term sickness, but no DLA and younger partner is unemployed, that they would not be able to access the sickness premiums in UC?

Sorry I Miss read this, after reading the schedules. It means those in the above catagory will automatically receive ESA, the rest have to apply, which means 13weeks in the assessment period. Better hope you’re not under-occupying as well :

It does seem a bit odd that you could get a disabled 90 year old having to do a work capability assessment.
