Mixed Age Couple-UC entitlement

Hi,

Have a mixed age couple, older partner is claiming SP of £611 every 4 weeks and private pension of £287 per month.
Younger partner gets PIP std mob, no other benefits claimed.
They are in a shared ownership scheme where they own 70pc of the property and management company own 30 pc.  They do not pay any rent, they pay a ‘management fee’ for upkeep of communal grounds and cleaning of windows which is £67.10 per month.
Older partner is putting a claim in for AA.
Younger partner’s health conditions have got worse and he is going to be asking for his PIP to be reassessed.
The get full council tax support.
I’ve done an initial benefits check which shows no entitlement to UC because of older partner’s pension income, however if they have LCWRA then it shows some UC entitlement of around £135 per month.
Can they claim UC?

Yes, reg.28(7) of the UC Regs 2013 allows for a 1p award to be made if they are only entitled to UC once the LCWRA element is included in the award. Make sure he sends in a fit note with the UC award although there have been reports on here about DWP telling people in this situation that they can’t be assessed under WCA which isn’t correct.
