A person with pre-settled status has a “right to reside” in the sense of being lawfully in the UK.

However, benefits such as UC which are subject to right to reside testing include exclusions of certain rights to reside which don’t count.

Pre-settled status is one of the types of right to reside which is ignored (e.g. reg 9(3)(c)(i) UC Regs).
