DLA Supersession Moving To PIP, No Invitation

I have a client who is 29 years old, she currently receives DLA Mid Care and Low Mobility.  She hasn’t yet received an invitation to apply for PIP. 

We feel she should be awarded a higher rate to recognise her mobility limitations.  Her conditions would not satisfy the the higher rate of the Mobility Component and in any case this would be a supersession meaning she would have to apply for PIP.

We believe she would score 12 points for Planning and following journeys, however of course the her entire circumstances would be reassessed.

Would her DLA claim/payment be stopped whilst a decision is being made on PIP?

She also receives IB ESA and is in the support group, not SDP as lives with father and brother whom are not excluded persons.

No - although there shouldn’t be too many adult claimants on DLA these days, the transitional arrangements still apply. Your client’s DLA would stay as it is whilst they went through the assessment process. Once their PIP claim is determined, DLA would stay in place until their last regular pay date plus 28 days and then PIP would take over.
