my client has been accepted as eligible to UC as destitute,aftre a lot of hard work pushing uC   singe woman child age 3 from slovenia pre settled, UC is paying for 6 months initially,
client has applied for LA housing LA housing officer is considering refusing homeless app on grounds client may not get uC after february 2025
anything could happen before then, if client is refused homeless accom cna we challenge it and on what grounds ???????????????/

It is likely that the decision in AT or something comparable applies to the assessment of eligibility for housing and homelessness as it does to welfare benefits. The LA should accept that she is eligible for assistance on this basis or should at least accept that it has ‘reason to believe’ that she may be eligible which may suffice. If the LA decides that she is not eligible for assistance, there are grounds on which to pursue a s.202 review. You should refer your client to a legal aid housing solicitor to advise further on the specifics of their case.

Thank you Elliot, yes I think a referral may be needed, having read the housing officer note via another source, no decision has yet been made BUT   it does look like they are hell bent on refusing homeless accom if they can get away with it,
she is detitute now, what state she will b ein next february is neither here nor there as far as I can see

well that was quick
LA has refused housing as homeless , they say she has no rights as she is not a worker etc etc etc ,
so can er rely on AT, any help please
I will refer her to sols right away but it would be good to know we are not wasting her time

yes of course, i was not implyig I dont have confidence in your adviec, just want to add a few notes to my case
anyway we are refrring her to sols who will no doubt put forward the argumant
