Hi all,

Has anyone dealt with a case where:

1. Claimant is sent invitation to claim PIP
2. does not do so
3. has DLA suspended
4. still does not claim within the relevant timeframe
5. has DLA ended; and
6. subsequently claims PIP and asks for the initial 28 days to claim period to be extended under reg 8(4)(b) PIP(TP) Regs (which reg 8(5) suggests can be extended after it has already expired).

I am wondering whether if the time is subsequently extended the DWP are happy to reinstate DLA?

Thanks,

Martin
