HB CTB QUERY RE PAYMENT WHILST SOMEONE IS IN HOSPITAL

Hi - am looking for help as Im going round in circles a bit with this one

I have a young lady who was hospitalised under S117 from the age of 14 to 21. She was given a tenancy in October 08 but was unable to move in straight away, because of her mental health, she had to go thru a phased "moving in" period i.e. she went to the flat 3/4 days per week with a carer to try and get her used to life skills and social skills. The HB and CTB have only covered the four week period prior to her moving in and therefore she has got a shortfall of about 8 weeks of rent.
Is it worth an appeal
Can I ask for a DHP to cover this period if they have deemed her no entitlement to HB/CTB for some of this period

Surely, if her stuff went into the flat and she started using it she had moved in? Or do we have a two-homes quandary here?

R(H) 09/05 is a much (ab)used CD, but it *may* be helpful in your client's case - it will depend on the facts.

Many thanks for help with this one I think the R(H) 09/05 has enough similarities and I have the CPN on side re delayed discharge so am going to go down this route.
