Funeral Payment - necessary costs

I have a client who has had the funeral payment for her brother limited to the costs of a cemetary in the borough that he was 'living in'. She buried him in a cemetary closer to her home which cost more. Her brother was living in a care home in a neighbouring borough but came under the responsibilty of the borough she lived in, she was also in the process of getting him moved back to her home where he used to reside. Is there anything we can argue or cite in order to get the full burial plot costs met, whcih are not just cultural reasons.

The Reg (7A of the Social Fund Maternity and Funeral Expenses Regs)itself is not specific,confining itself to the use of the phrase 'necessary costs' but Commissioner Rice goes in to the matter in some depth in his decision R(IS) 18/98 which deals with a similar situation to the one that you have.
