Appeal to Court of Appeal

Permission to appeal to CA has been granted by Upper Tribunal. Case involves SDP (meaning of 'resides with', 'household' and 'sharing accommodation'). I need someone to take case on, obtain public funding certificate and instruct counsel. Had contacted CPAG, but 17 days later I am still awaiting a response. Only 22 days left before the appeal needs to be lodged at the court.

I am happy to do instructions etc to counsel, and even to suggest barristers, but I need someone with LSC contract to get the certificate. Should be possible to use devolved powers initially, shouldn't be a problem getting certificate as permission has been granted.

I need someone to take this on urgently.

I think the case is a winner. Anyway, win or lose, should generate some useful revenue for the organisation that takes it on (especially if successful).

check the law society's find a solicitor page, and see if anyone in your area holds themselves out as doing benefits...

as for counsel, paul stagg of 1 chancery lane, who posts on here to good effect on occasion.

Another WRO / adviser understands the LSC has a directory - possibly online. I'm not familiar enough with it to navigate, but hopefully it helps.

Thanks for replies.

I know about directory and I know of local providers - but a different story from getting someone actually prepared to take case on. From past experience, seems a great unwillingness for people to take cases on to higher courts, certainly locally. I was always willing in the days when I worked under LSC contract.

Still, have had a response from CPAG now and hopefully we can progress case - but if anyone else fancies taking case on, please do contact me anyway in case CPAG can't take it on.

Have you tried the Public Law Project? They have an advice line on 0808 808 4546, but this might only be for LSC funded org's...

Thanks for all the replies.

Community Law Partnership in Birmingham have agreed to take on case.

I thought that I might have got some offers from at least some of the people who work for contracted agencies and solicitor firms that post on this site so frequently and give out advice to others so freely, but maybe this case was too difficult (though all the work has been done, it only required someone to get the legal aid application authorised and sent off - I would even have done the instructions to counsel if that was a problem).
