phew !!!
2nd post in as many minutes ...

have cl.s aged 67 (husband -h) and 60 (wife -w) from portugal.
w has been in uk for approx. 5 years and upon approaching 60th birthday on 17/11/08 received letter from jcp advising her she now had to claim p.c.
she claimed this but of course claim refused due to not having r2r, at same time h.b / c.t.b claim ceased.
h came to uk late 08 and on 23/03/09 began self-employed work of approx. 8 hours pw.
h claimed p.c and this was awarded, and h.b / c.t.b also.
however, if h ceases work p.c, h.b / c.t.b awards will cease due to not being economocally active,a nd w cannot work because of age / language difficulties.
my q. is if husband pays tax for a period of time will he obtain r2r in future if he has to cease work, and if so is there a period of time that paying tax would be acceptable.

hope this post makes sense and as ever, all replies greatly appreciated.

the w comes under the silly rules, ie : in receipt of i.s on basis of i.f.w prior to being advised to claim p.c by jcp, but then when she does is refused due to the changes to benefit rules re : r2r ... does that make sense ?

Seems that the IS was paid prior to R2R and so was transitionally protected....new claim breaks that although if HB has remained in payment all the way through i.e. prior to May 2004 then PC should be paid based on HB keeping the protection
