Have a case where partner claiming child benefit leaves and is no longer responsible for the children and not maintaining them but does not report this and continue to receive CB for several months. Person now responsible informed to claim and request backdating but is only paid from three weeks after the claim under Sch10 para1(2)SSCBA with client losing out on 3 months backdating plus 3 weeks! However should this only apply where both are actually entitled and the issue is priority. CB should have ceased for former claimant because the children were not living with the person claiming for over 56 days s143(2)SSCBA and was not maintaining them. Want to appeal this if feasible, so has anybody had a similar case and if so was it successful? Otherwise client losing out due to expartners fraud
